Abstract
Every open, democratic society requires a fundamental agreement – that is, a shared set of values. In Germany, this has long been encapsulated in the notion of Verfassungspatriotismus (constitutional patriotism), understood as the identification with the Basic Law and the Federal Constitutional Court’s jurisprudence. 75 years after the promulgation of the Basic Law, the force of this agreement appears less certain. Andreas Voßkuhle provides a historical account of Verfassungspatriotismus. Voßkuhle then analyzes the current standing of constitutional patriotism in public discourse. He argues that the integrative power of the specific ideas of constitutional patriotism is diminishing, which he illustrates with recent political developments and cases. Nonetheless, the political discourse in Germany remains more closely tied to constitutional values than in most other European countries.
