Abstract
The Council of Europe Special Tribunal for the Crime of Aggression – Legitimacy and Characteristics
There is a gap in the (international) criminal prosecution of the Russian war of aggression against Ukraine: neither the ICC is responsible here nor can the establishment of an ad hoc UN tribunal be realistically expected due to Russia's veto power in the Security Council. The Council of Europe's new special tribunal closes this legal policy gap. Since such authority is not explicitly provided for in the statutes of the Council of Europe, questions arise about its legitimacy. As a “mixed form” of ad hoc and so-called hybrid tribunals, the special tribunal follows the previous patterns of international criminal justice, but also has some special features, such as the possibility of proceedings/conviction in absentia.
