Abstract
Majoritarianism is a core element of democracy and is the subject of multiple theories. Models of absolute and relative majority, also known as plurality, relate to single preferences. Social choice theory, however, attempts to aggregate individual preferences into collective preference models that account for all preferences. The article applies social choice to democratic decision-making. Geschler argues that this model is required by Art. 20 sec. 1 and 2 GG, as well as that single preference models violate the principle of democracy, i.e., the subprinciple of preference sensitivity to allow for the highest degree of voters‘ self-determination. Furthermore, he claims that the model of Condorcet of 1785 is constitutionally permissible, and examines how it could be introduced by lawmakers.
